VQuip Pty Ltd (ACN 147 897 934) and its related companies (‘we’, ‘our’ or ‘us’) understand that many people are concerned about how their personal information that companies may collect and retain may be used.  This privacy policy confirms our commitment to ensuring the privacy and security of any personal information that we hold in conducting our in accordance with the Australian Privacy Principles established under the Privacy Act 1988.

The type of information we may collect and hold includes personal information about:

(a) customers, business associates, potential customers and their employees, contractors and agents;

In some cases we may also collect ‘sensitive information’, such as information about an individual’s membership of a professional association, criminal record or health information, and credit information and credit eligibility information about you, such as credit reports, consumer credit liability information and payment history.

For these purposes, we develop aggregate or summary (i.e. not individual) reports which incorporate some personal Information. These reports do not include any personally identifiable information.

 

4. COOKIES

We are committed to ensuring the security of your personal information and we will take all reasonable steps to protect it from misuse, interference, loss, unauthorised access, modification or disclosure, including:

(b) taking measures to restrict access to personnel who need that information in order for us to be able to provide our products and services; and

(c) technological measures, such as computer passwords, data back-up, anti-virus software and firewalls.

We take reasonable care to keep your personal information secure and confidential. We have security measures in place designed to protect against the loss, misuse and/or alteration of your personal information under our control. These security measures include restricting and securing access to our databases. We regard unauthorised use of or access to your personal information by our employees, contractors or agents as a serious matter that will be subject to appropriate disciplinary or other action.

 

7. HOW CAN YOU ACCESS, CORRECT AND UPDATE YOUR PERSONAL INFORMATION?

 

Subject to the exceptions set out in the Privacy Act 1988, you may seek access to and correction of the personal information which we hold about you by contacting our Privacy Officer.  We will require you to verify your identity and to specify what information you require. If a fee is charged for providing access, you will be advised of the likely cost in advance.

 

8. HOW CAN YOU ‘OPT OUT’?

 

From time to time we may use your personal information to provide you with marketing communications in relation to special offers, competitions, products and services that we have available. If you would not like to receive these communications from us you may opt out by contacting our Privacy Officer.

 

9. ARE WE LIKELY TO DISCLOSE YOUR PERSONAL INFORMATION OVERSEAS

 

We may disclose your personal information to the following overseas recipients:

(a) to third parties who assist us in providing services or who perform functions on our behalf (such as third party service providers);

(b) to anyone where we are required or authorised by law to do so; and

(c) to anyone else to whom you authorise us to disclose it.

If you consent to disclosure of your personal information as described above, we are not required to take reasonable steps to ensure that such organisations do not breach the Australian Privacy Principles established under the Privacy Act 1988 in relation to the disclosed information, we will not be liable under the Privacy Act 1988 and you will not be able to seek redress under the Privacy Act 1988. The overseas organisation may not be subject to any privacy obligations in their own country that are similar to the Australian Privacy Principles established under the Privacy Act 1988, you may not be able to seek redress in the overseas jurisdiction and the overseas recipient could be subject to foreign laws that compel disclosure to third parties, such as overseas authorities.  Having been informed of the possibility that such disclosures may occur, you consent to that disclosure by undertaking the type of activities specified above which indicate your consent.

 

10. APPLICATION OF EUROPEAN PRIVACY LAWS

 

If you are an individual in a country in the European Economic Area (EEA), we may be required to comply with the EU General Data Protection Regulation 2016/679 (the GDPR) which applies to us when processing the personal information of individuals (data subjects) who are in countries in the EEA in relation to offering you our products or services, or if we monitor any of your behaviour when in those countries. This Privacy Policy shall apply in such cases.

We are the data controller for our website and services provided through our website.

 

11. LINKS TO OTHER WEBSITES

 

We may provide links to other websites operated by third parties. We make no representations or warranties in relation to the privacy practices of any third party website and we are not responsible for the privacy policies or the content of any third party website. If you visit these websites, they will be governed by their own terms of use (including privacy policies).

 

12. NOTIFIABLE DATA BREACHES SCHEME

 

In the event of any loss, or unauthorised access or disclosure of your personal information that is likely to result in serious harm to you, we will investigate and notify you and the Australian Information Commissioner as soon as practicable, in accordance with the Privacy Act 1988.

 

13. HOW CAN YOU MAKE A PRIVACY RELATED COMPLAINT?

 

If you have any questions about privacy-related issues or wish to complain about a breach of the Australian Privacy Principles or the handling of your personal information by us, please contact our Privacy Officer. We may ask you to lodge your complaint in writing. Any complaint will be investigated by the Privacy Officer and you will be notified of the making of a decision in relation to your complaint as soon as is practicable after it has been made, usually within 30 days.

If we are unable to satisfactorily resolve your concerns about our handling of your personal information, you can contact the Office of the Australian Information Commissioner (www.oaic.gov.au).

 

14. MODIFICATIONS OR UPDATES TO THIS POLICY

 

This Privacy Policy will be reviewed from time to time to take account of new laws and technology, changes to our operations and practices and the changing business environment.  This Privacy Policy may be modified or updated at any time. When this occurs, we will post the new version of the Privacy Policy on our website.  We encourage you to periodically review this Privacy Policy so that you remain informed as to how we are protecting your personal information.

Please note that if at any time we are required by law to release your personal information, we must cooperate fully. This Privacy Policy does not apply to our acts or practices that relate to employee records of current or former employees.
